HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.7077 OF 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.517 of 2019 on the file of the II Additional Judicial First Class Magistrate at Mancherial.

A charge sheet came to be filed against the petitioner/A-2 for the offences punishable under Sections 379, 427 and 506 of the Indian Penal Code.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner/A-2 restricts his prayer seeking dispensation of the presence of the petitioner/A-2 before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioner/A-2 is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/A-2 in C.C.No.517 of 2019 on the file of the II Additional Judicial First Class Magistrate at Mancherial, is hereby dispensed with except on the dates when his presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous applications, if any, pending shall stand closed.
