THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.14486 OF 2007 ORDER:

This writ petition is filed to declare the notification issued under Section 4(1) of the Land Acquisition Act, 1894 (for short 'the Act') and the draft declaration under Section 6 of the Act, as illegal, arbitrary and contrary to the provisions of the Act and consequently to direct the respondents to drop the land acquisition proceedings in respect of the petitioner's house bearing D.No.8/86/9, Sannidhi Street, Tiruchanur Village and Panchayat, Tirupati Rural Mandal, Chittoor District.

This Court, while admitting the writ petition, granted interim direction in WPMP No.18198 of 2007, directing the respondents to maintain status quo with regard to the possession of house property bearing D.No.8/86/9 of Sannidhi Street, Tiruchanur Village and Panchayat, Tirupati Rural Mandal, Chittoor District.

The learned Assistant Government Pleader, on instructions, submits that as per the oral request of the petitioner to provide one shop near Tiruchanur temple to eke out her livelihood, a shop is provided and possession was also handed over to her vide TTD proceedings in Roc No.Rev2/13434/AEO(Rev)/Tpt/08, dated 19.11.2008.

Now, the learned counsel for the writ petitioner wants to withdraw the writ petition in the aforesaid backdrop. 5.

Accordingly, the writ petition is dismissed as withdrawn. No costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
