THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.19455 of 2011 ORDER:

This Writ Petition is filed claiming the following relief/s:- "......the petitioner herein pray that this Hon'ble Court in the interests of justice be pleased to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 1st respondent in not considering the representation dated 07.06.2011 made by the petitioner in regard to making illegal and unauthorised constructions by the respondents 2 to 4 without obtaining any sanction plan in respect of petitioner's property in an extent of 68 Sq. Yds. of land with a house bearing D.No.32-13/3-5A situated in Block No.

1/A, Moghalrajpuram, Vijayawada, Krishna District as illegal, arbitrary, violation of principles of natural justice and contrary to Article 21 and 300A of the Constitution of India and issue a consequential direction to 1st respondent to take appropriate steps preventing the Respondents 2 to 4 from making any illegal and unauthorised constructions without obtaining any sanction plan and to remove the constructions being made in respect of petitioner's property in an extent of 68 Sq. Yds. of land with a house bearing D.No.32-13/3-5A situated in Block No.

The Learned counsel for the writ petitioner submits that the sole writ petitioner had died and that his Legal Representatives, if any, have not consulted him and that it appears that the LRs, if any, are not interested in prosecuting the matter, and hence, the writ petition may be closed. Recording the said submission, the writ petition is closed as abated since no legal representatives of the deceased sole writ petitioner are brought on record. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall stand dismissed.
