HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.7956 of 2017 ORDER:

This writ petition is filed by petitioner seeking to direct the 1st respondent to take steps to implement the proceedings of the 2nd respondent in file No.699/C3B/EZ/GHMC/2016.

The case of the petitioner is as follows:

One V. Srinivasa Rao, S/o V. Gopal filed a suit against respondents Nos.2 and 3 for perpetual injunction and that the said suit was decreed. Aggrieved by the same, respondents Nos.2 and 3 filed appeals and the said appeals were allowed. Against the same, the petitioner, who is being represented by Special Power of Attorney Holder of V. Gopal filed second appeal before this Court and the same is pending. While so, the petitioner gave a representation to the Minister of Telangana (Municipal Administration) and basing on such representation, a direction was given to enquire into the matter. The 2nd respondent submitted proceedings impugned to the 1st respondent stating that the building owners in the property in question were requested to furnish ownership documents, but they refused and that it is necessary to issue notice to the building owners in the property in question for furnishing documents. The 1st respondent was requested to issue suitable orders to demolish the illegal constructions on the property in question. But no steps have been taken so far. 3.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The petitioner is directed to make a representation before the respondents concerned raising all the points, which were raised in this writ petition, on or before 30th July, 2017. On such representation being made, the respondents concerned are directed to pass appropriate orders in accordance with law, within a period of eight weeks thereafter."
