HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7891 of 2017 ORDER:
Heard learned counsel for the petitioner/ A1 of Crime No.89 of 2016 of Nellore V Town Police Station, SPSR Nellore District, registered for the offences punishable under Sections 452, 379, 427, 506 r/ w 34 I.P.C., which is outcome of the report of the 2nd respondent and learned Public Prosecutor representing the State before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition and the contents of F.I.R.
It is the main contention of learned counsel for the petitioner that due to civil disputes, a false complaint is lodged against the petitioner, that the suit filed by the petitioner was decreed in his favour, neither the victim nor her son given report but her brother-in-law after four days of the alleged occurrence given report with a viewed story and hence there is also delay in giving report.
Having regard to the above, there is nothing to interdict the investigation. The crime is pending since 2016, the Police are directed to complete the investigation within a period of two months from the date of receipt of copy of this order. In the meantime, the petitioner/ A1 shall not be arrested. This order will not prevent the Police to secure the petitioner/ A1 for the purpose of investigation, as and when required.
