THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5185 of 2016 ORDER:

The prayer of the petitioner in this case is as under: " The Hon'ble Court may be pleased to issue writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not considering the representation of the petitioner dated 02.02.2016 for allotment of Sand Reach, (De-siltation of sand from Reservoir/Tank) situated at Bridgilanka, Rajamahendraaram, East Godavari District, to the Society which can be conducted only by means of Boats (manually) as arbitrary, illegal, unjust and unconstitutional and in violation of principles of natural justice and against the Fundamental Rights guaranteed under Article 14 and 19 of the Constitution of India and pass such other order or orders as the Hon'ble Court deems fit and proper in the interest of justice."

Learned Assistant Government Pleader for Mines and Geology would state that in terms of the Government's revised sand policy as enumerated in various GOs issued in January and February, 2016 and the guidelines laid down in Memo No.3066/M.II(1)/2016-3 dated 04.03.2016 issued by the Industries & Commerce Department of the Government of Andhra Pradesh, the application of the petitioner would be considered by the District Collector, East Godavari District.

In that view of the matter, this Court does not deem it necessary to interfere in the matter at this stage by entertaining this writ petition.

4. The Writ Petition is accordingly disposed of directing the District Collector, East Godavari District, the third respondent, to

consider the petitioner's representation dated 02.02.2016 in accordance with the revised sand policy and the new guidelines and take appropriate action in the matter. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
