HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.4670 of 2015 in Crl.P.No.4202 of 2015 and Criminal Petition No.4202 of 2015 COMMON ORDER:
T h e defacto complainant and her Counsel Sri S.Chandra Mohan Reddy are present. A.1 and A.2 and their Counsel Sri C.M.R. Velu are present.
On the report given by the defacto complainant, the Police of Alwal P.S, Cyberabad, registered a case in Crime No.630 of 2013 and after investigation laid charge sheet against accused for the offences under Sec.498(A) I.P.C and Sec.3 & 4 of D.P.Act and the learned XXI Metropolitan Magistrate, Cyberabad at Medchal took cognizance of the case and registered as C.C.No.128 of 2015. While so, today the defacto complainant and A.1 and A.2 and their respective Counsel present in Court and submitted that at the intervention of elders they have amicably resolved all their disputes and as per the terms of settlement, they propose to obtain divorce and in fact A.1 already filed Divorce O.P.No.1491 of 2014 before the Judge, Family Court, Ranga Reddy District at L.B.
Nagar and the maintenance claim of complainant was also taken care and accused agreed to pay Rs.12,00,000/- and accused have already paid Rs.6,00,000/- to her through D.D. bearing No.810650 dated 13.04.2015 drawn on Oriental Bank of Commerce, Sukapr, Kapra Branch and today the accused are paying balance of Rs.6,00,000/- to her through D.D. bearing No.810701 dated 28.04.2015 drawn on Oriental Bank of Commerce, Sukapr, Kapra Branch and in view of the said settlement, the complainant has no objection for quashment of proceedings and hence this Court may be pleased to accord permission to compromise the matter and compound the offences and accordingly, quash the proceedings in C.C.No.128 of 2015 on the file of XXI Metropolitan Magistrate, Cyberabad at Medchal in the interest of justice.
In view of the above submission and considering the fact that it is a matrimonial matter wherein the parties have amicably resolved their disputes and further, no useful purpose will be served even if they are driven to trial since they have compromised and following the decision reported in Gian Singh vs. State of Punjab and another, this petition is allowed and permission is accorded to the parties to compound the offence and consequently, the proceedings in C.C.No.128 of 2015 on the file of XXI Metropolitan Magistrate, Cyberabad at Medchal are hereby quashed in terms of joint compromise memo filed by the parties.
In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
