This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Reddamaina Thirupathi, Advocate for the Petitioner and Sri Syed Yasar Mamoon, Additional Public Prosecutor on behalf of the Respondent. j i ij The Court made the following: ORDER

i tI I!iii i This criminal petition is filed by the petitioner/A.1 seeking regular bail in connection with C.O.R.No.S4 of 2025 of Malkajgiri Prohibition and Excise Station, Medchal Malkajgiri District. The offences alleged against the petitioner are under Sections 8 (c) r/w.22 (cl and 2O (bXiiXA) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short'NDPS ActJ. 2.

The case of the prosecution is that on 20.06.2025 on reliable information about sale of MDMA, when the Excise Sublnspector of Police, proceeded to premises bearing H.No.29L4421149, Sri Sai Nagar, Neredmet Village the petitioner along with other accused were present in the said house and when searched the house, the police found 22.LO grams of MDMA, 6.60 grams of OG and one vehicle and mobile phones. The same were recovered under the cover of panchanamas and registered the case against the accused for the above said offenses.

Heard Sri R. Thirupathi, learned counsel for the petitioner and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of respondent - State. ABK/PSL

The contention of learned counsel for the petitioner is that the petitioner is A.1 and he is doing private job and atl the accused are friends. A.1 and A.4 are acquainted with each other as they both worked together at Bangalore and A.4 used to visit Hyderabad and stay with A.1. Likewise, A.4 recently came to Hyderabad and kept his bag in the house of A.1 and the petitioner herein is not aware of the substance in the said bag. Petitioner is no way connected with this offence and he has been falsely implicated in this case. He further submitted that petitioner was arrested on 20.06.2025 and since then he is languishing in jail. The petitioner along with A.2 and A.3 earlier filed Crl.P.No.8426 of 2025 and the same was dismissed on 23.O7.2025 on the ground that investigation in still in progress. He further submitted that the petitioner had got fixed abode and he is ready to furnish sureties and abide by the conditions that may be imposed by this Court and undertake to cooperate with the investigation. As such, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the contraband seized from the accused is a huge commercial quantity and it is recovered from all the accused. Further the investigation is not yet completed

and at this stage, if the petitioner is released on bail, it may II cause hardship to the investigating agency and there are no it changed circumstances from the earlier bail application. As '

such, prayed this Court to dismiss this bail application. 6.

Having regard to the submissions made by both the counsel and the material on record, the police seized 22.LO grams of MDMA, 6.60 grams of OG which is a huge commercial quantity. Further, this is the second bail application and it is noticed that there are no changed circumstances back then from the earlier bail petition, and the present bail petition. As such, this Court is not inclined to grant the relief zrs sought for, by the petitioner. There are no merits in this Criminal Petition, and the same is liable to be dismissed.
