Heard learned counsel for the petitioner and learned Government pleader for School Education.

The application submitted by the petitioner-management to fill up the aided vacancies is rejected by the District Educational Officer, Prakasam vide his proceedings dated 28.03.2018 on the ground that though the Commissioner of School Education issued orders to fill up the aided vacancies in various institutions vide his proceedings dated 20.07.2017, but later the said order was kept in abeyance and therefore, the request of the petitioner was not considered.

When the matter is taken up, learned counsel for the petitioner as well as learned Assistant Government pleader fairly submits that there is no ban imposed as of now and the District Educational Officer is competent to consider the request of the petitioner to fill up the aided vacancies.

In view of the same, the order impugned is set aside and the matter is remitted to the District Educational Officer, Prakasam District, Ongole, to examine the request of the petitioner as made in the representation dated 05.03.2018 for permission to fill up the existing aided vacancies. A decision shall be taken and appropriate orders be passed and communicated to the petitioner within a period of four (4) weeks from the date of receipt of copy of this order.
