Smt Reddy Devi Parvathi, Hyderabad., v. M.Srinivasa Krishna, Eg.Dt And 2 Otrs, Rep Pp.,
HONOURABLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.889 of 2017 ORDER:
There is no representation on behalf of the petitioner. On 30.3.2017, this Court permitted the Counsel for petitioner to take out personal service of notice on respondent Nos.1 and 2 by registered post with acknowledgement due. However, no such notice seems to be issued by the petitioner. Again on 28.7.2017, this Court permitted the Counsel for the petitioner to take out fresh personal notice on respondents 1 and 2 through RPAD and file proof of service in the Registry. Even then, it appears that no personal service of notice is issued and no proof of service is filed.
2.
Further, on 10-11-2017 and 20-11-2017, the matter was adjourned at the request of the Counsel for petitioner. On 21.11.2017, this Court narrating the dates of earlier occasion, once again permitted the Counsel for petitioner to take out fresh personal notice on respondents 1 and 2. Thereafter, the matter was listed on 5.12.2017, 18.1.2018 and 18.4.2018, on all these three occasions, there was no representation on behalf of the petitioner. Therefore, the matter was posted under the caption of "For Dismissal". Even today also when the matter is listed under the caption of "For Dismissal", there is no representation on behalf of the petitioner. Hence, this
Court is of the opinion that the petitioner is not interested to prosecute the present Criminal Revision Case. Accordingly, the Criminal Revision Case is dismissed for non-prosecution. 3.
Miscellaneous Petitions, if any, pending, shall stand closed. ________________________ JUSTICE P. KESHAVA RAO Dated:11-6-2018 gnr
