THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17049 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondent No.1 & 2 in trying to dispossess the petitioners from the land extent Ac.4.00 cents in Sy.No.218, 219 and 220 of Yerraguntlakota Village, Obulavaripalli Mandal, Kadapa District without following due process of law as arbitrary, illegal and contrary to section 83 of the A.P. Charitable Hindu Religious Institutions and Endowments Act, 1987 and consequently direct the respondents not to dispossess the petitioners from the land extent Ac.4.00 cents in Sy.No.218, 219 and 220 of Yerraguntlakota Village, Obulavaripalli Mandal, Kadapa District without following due process of law in the interest of justice."

The main grievance of the petitioners is that the respondents are trying to dispossess them from the subject property without following the due process of law and they are also trying to auction the subject property.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioners, without going into the merits of the case, the respondents are hereby directed not to dispossess the petitioners from the subject property without following the due process of law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
