This Writ Petition is filed challenging the action of the 3rd respondent - disciplinary authority in not furnishing the documents based on which a charge was drawn against the petitioner.

During the course of arguments, learned counsel for the petitioner fairly submitted that a reasonable opportunity may be granted to the petitioner to submit his explanation to the charge memo and only after considering the said explanation, further proceedings should be initiated against him.

Having regard to the said submission, without expressing any opinion on the merits of the case, the Writ Petition is disposed of granting liberty to the petitioner to submit his explanation to the charge memo dated 06.04.2018 within two weeks from today and on consideration of the said explanation, if the same is filed within two weeks from today, the disciplinary authority shall take steps in accordance with law. It is needless to observe that it is open to the petitioner to raise all objections during the course of disciplinary proceedings. Pending Miscellaneous Petitions, if any, shall stand closed.
