THE HON' BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24183 of 2019 ORDER:

The petitioner complains inaction of the 2nd respondent on the representations submitted by her on 15.12.2018 and 13.02.2019 for cancellation of plot regularization proceedings dated 20.06.2018 granted in favour of 4th respondent.

As can be seen from the material documents filed by the petitioner, the first complaint of the petitioner is dated 15.12.2018, addressed to the 2nd respondent. It may also be noted that the petitioner approached the Civil Court and obtained injunction on 23.01.2018 which fact also was mentioned in the representation dated 15.12.2018. The same was followed-up with yet another representation on 13.02.2019. Based on the same, a notice came to be issued to the 4th respondent on 19.08.2019, for the first time, by the 2nd respondent, granting seven days time to respondent No.5. It is not clear as to whether any reply has been submitted by respondent No.5.

On 09.09.2019, the petitioner, by enclosing the Show Cause notice issued by respondent No.2 dated 19.08.2019, addressed a letter to respondent No.3 with a request to not grant permission to respondent No.4. However, the respondent No.3 appears to have ignored the letter of the petitioner, dated 09.09.2019 and granted building permission on 14.10.2019.

wp_24183_2019 CKR, J In those circumstances, though learned counsel for 2nd respondent No.2 as well as learned counsel for 3rd respondent seek eight weeks' time for passing orders on the complaint of the petitioner, this Court is not inclined to grant much time, as there already inordinate delay on the part of the respondents 2 and 3 which appears to be a deliberate act. However, considering the request of the learned counsels, four weeks' time is granted to respondent No.2 to act on the complaint of the petitioner and pass final orders, in accordance with law.

Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any pending, shall stand closed. ___________________________ CHALLA KODANDA RAM, J 05th November, 2019 KSM
