THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.23362 of 2009 ORDER:
When the matter was called yesterday, initially, there was no representation for the petitioners, as such, it was passed over. Later, when it was called, learned counsel for the petitioners sought time and learned counsel for the respondents submits that the issue in this Writ Petition is squarely covered by the common order, dated 28.08.2015 passed by the Division Bench of this Court in Writ Appeal No.702 of 2010 and batch. Therefore, this Court while directing the Registry to list the matter under the caption 'For Dismissal', adjourned the matter to today so as to enable the learned counsel for the petitioners to verify whether the subject matter of the Writ Petition is covered by the aforesaid common order or not.
Today, when the matter is taken up, learned counsel for the petitioners submits that the matter may be decided on merits. However, he refused to argue the matter.
In those circumstances and as the matter is listed today under the caption 'For Dismissal' and is of 2009, it is presumed
CKR, J WP.No.23362 of 2009 that the petitioners are no longer interested in prosecuting the Writ Petition.
Accordingly, this Writ Petition is dismissed for non-prosecution.
