The present writ petition is filed questioning the inaction of the third respondent in conducting investigation into FIR No.1140 of 2019 registered for the offence under Section 420 read with Section 34 IPC, through the said case was registered on 16.08.2019. 2.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 07.11.2019, which is placed on record of this Court, would submit that based on the complaint of the petitioner, the aforestated case in FIR No.1140 of 2019 was registered on 16.08.2019. During the course of investigation, L.Ws.1 and 2 were examined and their statements were recorded, accused Nos.1 and 2 were arrested on 19.08.2019 and were remanded to judicial custody. He would further submit that investigation into the matter has been completed and a charge sheet was filed before the learned XIV Metropolitan Magistrate, Rajendranagar, on 18.10.2019 and the case is numbered as C.C.No.2405 of 2019 and the same is pending trial.

Learned counsel for the petitioner submits that though the petitioner has named accused No.3 in the complaint filed, the third respondent deleted the name of accused No.3 while filing the charge sheet.

Inasmuch as the charge sheet has already been filed before the learned XIV Metropolitan Magistrate, Rajendranagar, on 18.10.2019 itself

and the case is already numbered and pending for trial, it is open for the petitioner to approach the concerned Court for redressal of her grievance in accordance with law.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
