HONOURABLE DR.JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No. 6471 OF 2018 O R D E R :

The petitioners are A-2 and A-3 among three accused of Crime No. 81 of 2018 of Mallial Police Station, Jagtial district for the offence punishable under section 302, 109 read with section 34 of I.P.C. They are in judicial custody since 28/5/2018.

2. The alleged occurrence was on 14/5/2018 at about 11:00 p.m. The contention of the counsel for the petitioners are that they are innocent and falsely implicated, it is the act of A-1 roped A-2 as if at the instance of A-2, A-1 committed the act and so far as A-3 is concerned, it is not even a case that he engaged A-1 but for if at all A-2 and mere drafting of a cheque given by A-2 as consideration for the accomplished act achieved by A-1 cannot make him liable for the grave offence and they are falsely roped and they are in judicial custody for the past one month and the family are suffering being they are the bread winners, hence they are entitled for concession of bail.

The learned Public Prosecutor opposed the bail application, saying that it is a ghastic crime for a silly thing with a premeditation and they are all privy and with common concept from the nefarious claim achieved the accomplished act thereby and from the investigation in progress does not deserve the concession of bail.

4. Heard perused the material on record.

5. Though it is one of the contentions that A-3 only drafted the cheque given by A-2 to A-1 as a consideration for the accomplished act. The remand report shows all the three consumed liquor prior to that. That too when the investigation is in progress, this Court no way feels it just that at this stage to consider the plea of bail even for A-3.

6. Accordingly, this Criminal Petition is dismissed.

7. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
