THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.21155 of 2018 ORDER:

When the matter is taken up, it is brought to the notice of this Court by learned counsel for the petitioner so also the learned Standing Counsel for the respondent-Municipality that in similar circumstances, a Division Bench of this Court passed an Order in W.A.No.477 of 2018, dated 22.03.2018. A copy of the same is filed along with writ petition as material papers. The operative portion of the said order reads as under:

"Suffice it, therefore, to set aside the order under appeal and direct the appellants to redeliver possession of the subject land to the respondent-writ petitioners' which they own. The respondent-writ petitioners are entitled to carry on business, raising temporary structures on their land, till they are either allotted shops in the Shopping Complex to be constructed by the Municipality, or their lands are acquired in accordance with the provisions of the 2013 Act."

Following the said order and for the reasons stated therein, this writ petition is also disposed of in terms thereof. There shall be no order as to costs.

Office to enclose a copy of the order, dated 22.03.2018, in W.A.No.477 of 2018 to this order.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
