HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.1 and 2 of 2019 In/and CRIMINAL PETITION No. 7619 of 2019 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in M.C.No.153 of 2018 on the file of Addl. MSJ for trial of JHCBBC at Nampally, Hyderabad.
2. During the pendency of the criminal petition, the 2nd respondent filed I.A.Nos. 1 and 2 of 2019 to record the compromise and to compound the case. Along with the petitions, a joint memo came to be filed, which is supported by the affidavit of the second respondent. It is stated that in view of the amicable settlement between the parties at the intervention of elders and well wishers, the petitionerhusband has agreed to pay a sum of Rs.4,00,000/- towards full and final settlement and the respondent-wife agreed to withdraw the case upon receiving the said amount of Rs.4,00,000/- as full and final settlement. The petitioner has handed over demand draft for Rs.4,00,000/-, dated 30.10.2019 drawn on State Bank of India, Gunfoundry branch, Hyderabad. The respondent-wife has acknowledged to have received the said demand draft for Rs.4,00,000/-. Copy of the demand draft is also annexed to the petition.
Therefore, it is prayed to record the compromise and quash the proceedings.
3. Today, both the parties are present before this Court and submitted Aadhar cards, which show their identity. They are also identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the proceedings against the petitioners.
4. In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.Nos.1 and 2 of 2019 are ordered.
5. Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in M.C.No.153 of 2018 on the file of Addl. MSJ for trial of JHCBBC at Nampally, Hyderabad, are hereby quashed. Miscellaneous petitions, if any pending shall stand closed. _______________________ JUSTICE G. SRI DEVI DATED: 06.12.2019.
