THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2983 OF 2015 ORDER:
The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the notice of forfeiture of Bond for Good Behaviour in M.C.No.4980 of 2015, dated 03.10.2015, issued by the Executive Magistrate, Kodad, . Heard and perused the material available on record. Learned counsel for the petitioner submits that the petitioner has given the explanation on 07.10.2015, but the respondent has not considered the explanation and has not passed any orders. Considering the facts and circumstances of the case, Executive Magistrate, Kodad, is directed to decide the issue on the basis of the explanation given by the petitioner herein.
It is made clear that if the authority passes any order against the petitioner herein, the authority is directed to suspend the said order for a period of fifteen (15) days to enable the petitioner herein to approach the appropriate forum. However, if the authority already passed the order, the same is hereby suspended till 05.01.2016 to enable the petitioner herein to approach the appropriate forum.
With the above direction, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed.
