THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4764 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue a writ order or orders or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 1 and 3 herein in not passing the interim order and not issuing the dispatch permits to the petitioner for Road Metal & Building Stone to an extent of 0.860 Hector in Sy.No.1072 in Basinikonda Village, Madanapalli Mandal, Chittoor District on the stay application filed along with the Revision Petition No.10607/M I (1)/2015 on 23.09.

2015 is illegal arbitrary and unjust and it is violative of Rule 34 of APMMC Rules 1966 and also violation of article 14, 21 and 300A of the constitution of India and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case." As it is admitted that the petitioners' revision is pending consideration along with the stay application filed therein and her primary grievance appears to be the inaction on the part of the revisionary authority in disposing of the stay application, this Court is not inclined to entertain this writ petition and adjudicate the same on merits.

In that view of the matter, the writ petition is disposed of directing the revisionary authority, the State of Andhra Pradesh, to take up the petitioner's pending stay application, consider the same on merits in accordance with law and dispose it of by way of a reasoned order. This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ___________________________
