THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38664 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the second respondent in calling the petitioner to police station in relation to crime No.259 of 2016, though the order of this Hon'ble Court in W.P.No.36065 of 2015 as illegal and arbitrary.
Heard and perused the material.
Learned counsel for the petitioner submits that though the crime No.259 of 2016 is registered as woman missing and that the same is not a cognizable offence, the second respondent is trying to handover the petitioner to the third respondent Home and in this connection, the second respondent is frequently calling the petitioner to the police station. He further submits that on the earlier occasion, when the petitioner fell in love with one A.Ramesh, the father of the petitioner made allegations against A.Ramesh, a case was registered as 'woman missing', a writ petition is also filed by the father of the petitioner seeking to handover the petitioner to him or alternatively to keep the petitioner in third respondent home, and as such, the petitioner has been in third respondent Home.
He further submits that the petitioner is a Major and she came out of the third respondent Home and married A.Ramesh. He further submits that there is apprehension of arrest in the hands of the second respondent and as such, he seeks to quash the F.I.R.No.259 of 2016. The petitioner appeared before this Court along with A.Ramesh and submits that she married A.Ramesh and they are leading happy marital life and she is not having any grievance.
Considering the facts and circumstances of the case and also considering the fact that the petitioner and her husband are leading happy
marital life, the F.I.R.No.259 of 2016 on the file of the second respondent is hereby quashed.
The writ petition is accordingly allowed.
