HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.3559 of 2018 ORDER:

Aggrieved by the dismissal of an application for appointment of an Advocate Commissioner, the plaintiff in a suit for declaration and recovery of possession has come up with the above revision.

2. Heard Mr. K. Rathanga Pani Reddy, learned counsel for the petitioner.

3. The main reason why the petitioner wanted the appointment of the Advocate Commissioner is stated in paragraph 3 of the affidavit in support of the application. It reads as follows: "I further submit that to prove my contentions in the suit, it is necessary to appoint an Advocate Commissioner to visit the plaint schedule property and to note down the physical features of the same and to take measurements of the plaint schedule property with the aid and assistance of the qualified surveyor and to file his report."

4. The portion extracted above is sufficient to dismiss the application. Hence, I do not find fault with the order of the trial Court dismissing the application.

Therefore, the Civil Revision Petition is dismissed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
