O R D E R
The 1st petitioner is the wife of the 2nd petitioner. Their case, as per the averments made in the writ affidavit, is that the father of the 2nd petitioner is in possession and enjoyment of house property bearing No.9-50, Budi Kistaiah Road, Mancherial Town and Mandal, Adilabad District, admeasuring 1,446 sq. yards. Their ancestors were in possession of the said property, since 1940. The Government issued G.O.Ms.No.765 Revenue (ASN.IV) Department dated 21.6.2008, for regularisation of encroachments in Sy.No.87, 388, 418, 420, 426 of Poramboke Government lands situated within Mancherial Municipal Limits, Adilabad District in favour of occupants of Mancherial town. The 3rd respondent - District Collector, through letter dated 1.5.
2015 sought for clarification from the 2nd respondent - Special Chief Secretary and Chief Commissioner of Land Administration, Hyderabad for implementation of G.O. Ms.No.765. The grievance of the petitioner is that though he made an application on 23.3.2015 to the 3rd respondent - District Collector, seeking regularization in terms of G.O.Ms.765 dated 21.6.2008, the same has not been considered till date, on the ground that the 3rd respondent has not received any clarification from the Government. Hence the present writ petition.
Heard the learned counsel for the petitioner and the
learned Assistant Government Pleader for Revenue for the respondents.
Having regard to the above averments and the submissions of the learned counsel, the writ petition is disposed of at the stage of admission, directing the 3rd respondent - District Collector, to consider the application dated 23.2.2015 said to have been made by the petitioners and pass appropriate orders thereon, in accordance with law, within a period of three months from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions pending if any, shall stand closed.
