It is evident from the record that the petitioner herein is a defendant in the suit for declaration of title filed by respondents 5 to 8. Hence, if at all the petitioner seeks a survey, it is for him to seek appropriate directions from the competent Civil Court, where the said suit is pending, and cannot approach any of the authorities.

In that view of the matter, the writ petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
