THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2621 of 2016 ORDER :
Heard the learned counsel for the petitioner and the learned Public Prosecutor for the respondent.
2. The petitioner, who is accused No.1, in Crime No.1 of 2016 of Mahila Police Station, Tirupati, Chittoor District, file the present application under Section 439(b) read with Section 482 Cr.P.C. seeking relaxation of the condition imposed by the Court of IV Additional Judicial Magistrate of First Class, Tirupati, in the order, dated 22.01.2016, passed in Crl.M.P.No.188 of 2016 in Crime No.1 of 2016.
3. By an order, dated 22.01.2016, the Court below while granting bail to the petitioner, imposed a condition directing the petitioner/A-1 to attend before the S.H.O., Women P.S. on every Sunday between 10.00 A.M. to 12.00 noon for a period of two (2) months or until filing of charge sheet, whichever is earlier.
4. Having regard to the fact that the petitioner is a student and studying P.G. Medicine in Pravara Institute of Medical Sciences (Deemed University), Loni, Rahata, Ahmednagar, Maharastra State, the condition of reporting on every Sunday in between 10.00 A.M. to 12.00 noon for a period of two (2) months is hereby relaxed. However, the petitioner shall make himself available as and when required by the S.H.O. concerned. Further, the petitioner shall not leave the country without the prior permission of the trial Court.
