THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.11438 OF 2017 ORDER:

Petitioner claims employment in Government service of State of Andhra Pradesh in accordance with the scheme formulated in G.O.Ms.No.98, dated 15.04.1986.

The service grievance of any person with reference to the employment in the State of Andhra Pradesh vests in Andhra Pradesh Administrative Tribunal constituted under the Administrative Tribunals Act, 1985 (for short, 'the Act'). The Andhra Pradesh Administrative Tribunal is the Court of first instance to adjudicate all service grievances of the State of Andhra Pradesh. The remedy available under the Act is effective and efficacious. Without availing the said remedy, the petitioner filed this Writ Petition.

Since the petitioner has an effective and efficacious remedy under the Act, this Court is not inclined to entertain the Writ Petition.

The Writ Petition is accordingly dismissed leaving it open to the petitioner to avail the remedy available to him under the Act. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
