HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITON No. 3123 of 2003 O R D E R:

This writ petition is filed seeking a writ of Certiorari calling for records connected to and pertaining to the Award dated 23.07.2001 passed in ID No.108 of 1998 by respondent No.2 and quash the same as illegal and arbitrary.

When the matter is taken up for hearing, it is noticed that on 18.08.2010, this court directed learned counsel for petitioner to take steps to effect service of notice on workman-respondent No.1 within four weeks from the date of the said order, failing which the writ petition shall stand dismissed as against respondent No.1 without further reference to this court. Since the said order has not been complied with, the writ petition was dismissed as against respondent No.1 and the petitioner has not taken any steps to restore writ petition against him. In absence of respondent No.1, the writ petition cannot be adjudicated on merits.

Accordingly, the writ petition is dismissed. No costs. Miscellaneous Petitions, if any, pending in this writ Petition shall stand dismissed.
