THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO.33215 OF 2013 ORDER:

Heard the learned counsel for the petitioner as well as the learned GP appearing for respondent Nos. 1 to 4. 2.

The prayer sought in the Writ Petition is as under: "to issue a writ, order or direction more particularly one in the nature of writ of mandamus to declaring the action of the Respondent Nos. 3 & 4 in calling the Petitioner before them to settle the Civil Disputes and threatening to take action if not come for settlement with the 5th Respondent in the Police Station as illegal, arbitrary and unconstitutional and Violative of Article 21 of Constitution of India and consequently direct the Respondent Nos. 3 & 4 not to call and interfere with the Civil Disputes without there being any Registration of Complaint against the Petitioner to the Police Station for Settlement." 3.

The main grievance of the petitioner is that respondent Nos. 3 and 4 are calling the petitioner before them to settle the disputes with respondent No.5 and threatening the petitioner that action would be taken against him on his failure to come for such settlement.

In the counter affidavit filed on behalf of respondent No.4, it is specifically stated that as of now, no complaint or

case of whatsoever is received or registered against the petitioner. It is also denied that the petitioner has been summoned to the police station at the instance of respondent No.5 and he was made to wait till evening and threatened him to come for a settlement with respondent No.5. It is also stated that the dispute between the petitioner and respondent No.5 is purely civil in nature and respondent No.4 has nothing to do with it.

In the light of the above said submission, this Court is of the opinion that no further orders are required in the Writ Petition.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
