1 and 2 and learned public prosecutor for 1st respondent-state before admission and before ordering any notice to de facto complainant-2nd respondent. Perused the FIR and the petition averments. 3) Undisputedly investigation is in progress. The petitioners are not even arrested by the police and not called for so far. The crime is outcome of private complaint made by the de facto complainant that was referred by the Court for investigation. After registering the crime under Section 154, as per Section 156 (3) Cr.P.

C there is no specific offence of entrustment to attract under Section 406 IPC is one of the contentions besides element of deception from the inception regarding the so called payment of amount apart from any proof in this regard to attract the offence of cheating and there is no specific mention as to any using of deadly weapon in causing any voluntary simple hurt to attract Section 324 IPC. As the investigation is in progress and how far the occurrence taken place is within the prerogative of the police to investigate and what penal provisions would attract from investigation if at all is filing final report either in the form of charge sheet, if not, as referred report if no case is made out from the investigation.

4) The Criminal Petition is disposed of, since it is premature to quash the FIR but for to say the petitioners are given liberty to surrender before the Learned Magistrate concerned and then move for regular bail with notice to learned Assistant Public Prosecutor concerned and in such an event, the learned Judge/Magistrate shall consider for granting of bail in his favour with necessary conditions preferably on the same day if not at least by the next day and dispense with the personal appearance during investigation till filing of final report. It is left open to the petitioners to seek any remedy if at all in the event of police filing charge sheet. 5) Miscellaneous petitions, if any pending, shall stand closed. _________________________ Dr. B. 2015 knl​ 3) As there are no grounds to admit the Criminal petition filed under Section 482 Cr.P.C and the same is disposed of with the following observation: Receiving of document is some what different to the marking of a document as per the propositions of law. Even police did not collect the documents as part of the investigation before filing charge sheet under Section 173 Cr.P.C in the form of final report and that enables the police under Section 173 (8) of Cr.P.C at best by intimation or permission of the Magistrate concerned to collect and submit supplementary charge sheet showing further investigation, as per the settled law that is not by all and all. To say that scope is entirely different knowing curtails the power of the Court to receive any document or to any witness in investigation under Section 3 (11) of Cr.P.

C apart from the power of the Court under Section 165 of Evidence Act. Once the lower Court exercised the discretion in along the application filed by the public prosecutor under Section 3 (11) of Cr.P.C do not mentioning the same that was allowed in receiving the so called copies of documents, the contention there from without factual foundation about existence of original, the secondary evidence could not be permitted to let in and when there is no secondary evidence that is admissible the receiving of the documents is illegal to set aside the lis present impugned. As referred supra besides Section 165 of Evidence Act enables the Court, Section 231, 242 and 244 Cr.P.

C also enables the Court is as the case is under police warrant case procedure to receive any application for filing of document or examination of witness and to permit under Section 3 (11) of Cr.P.C or under Section 165 of Evidence Act. In fact, even any such ____ without laying foundation for secondary evidence in Criminal proceeding referred to the provision supra. The Apex Court categorically laid in Bipin Shantilal Panchal vs. State of Gujarat​ Punjab that any objection regarding admissibility or relevancy to be raised while marking the document subject to objection ultimately after completion of trial and not instantly but for touching requirement of stamp duty and registration or the lie.

Having regard to the above, the receiving of document is not end all and remedy is open to the petitioners herein to raise any objection while marking in saying the same inadmissible in secondary evidence for want of finalise about the existence of original, same is left open. Needless to say for the Court to follow the procedure as laid down in Bipin Shantilal Panchal (supra) and all the rights to raise objection and impugning the admissibility and relevancy left open to the accused to raise at the appropriate stage and for the trial Court to decide at the appropriate stage as laid in Bipin Shantilal Panchal (supra).
