HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION Nos. 33415 and 33421 of 2015 COMMON ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard Smt.K.Rajitha, learned counsel for the petitioners, and Sri Taddi Nageswara Rao for respondent No.2. None appears for the contesting respondent No.3.

The petitioners were admitted to M.B.B.S. course 'B' category. They had furnished bank guarantee for Rs.36,00,000/- towards tuition fee covering four academic years including academic year 2015-16. By this writ petition, they seek permission to withdraw the said bank guarantee and furnish bank guarantee for Rs.9,00,000/- towards tuition fee chargeable for succeeding year.

In the circumstances, we dispose of these writ petitions by the following order:

"Respondent No.3 is directed to return the bank guarantee of Rs.36 lakhs furnished by the petitioners within a period of three weeks from today on the petitioners furnishing bank guarantee for Rs.9,00,000/- each for a period of one year expiring on 31.08.2016 towards the tuition fee for the academic year 2015-16. The

petitioners shall renew the bank guarantee for every succeeding year well in advance. The petitioners to furnish undertaking to this Court within a period of three weeks from today stating that they shall furnish and keep the bank guarantee alive for every succeeding year. It is needless to mention that the petitioners shall forward a copy of their undertaking to respondent No.3." Miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs.
