HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21184 OF 2018 O R D E R :

The grievance of the petitioner is that she made a complaint on 31.05.2018 and 07.06.2015 against the brother of her husband before the 3rd respondent, as no action has been taken on the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that since the complaint of the petitioner is non congnizable offence, a requisition was filed before the II Metropolitan Magistrate, Cyberabad at L.B.Nagar, to accord permission to proceed with the non-cognizable complaint of the petitioner dated 07.06.2018; that as soon as permission is obtained, further course of action will be taken against the concerned persons by way of registration of FIR. Learned counsel for the petitioner states that even after filing second complaint by the petitioner on 07.06.2018, the accused are threatening the petitioner with dire consequences. In view of the same, the 3rd respondent is to take appropriate action on the complaint of the petitioner as soon as possible in terms of the Judgment rendered by the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1 and communicate a copy to the 2nd respondent also, since the petitioner

is alleging that the 3rd respondent is not acting on the complaint promptly. It is also open for the petitioner to make fresh complaint if the accused is threatening the petitioner with dire consequences. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
