THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8691 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 and 2 seeking bail in the event of their arrest in connection with Crime No.285 of 2023 on the file of Manuguru Police Station, Bhadradri Kothgudem District, registered for the offences under Sections 417, 420, 376 and 506 of IPC.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioners are seeking the relief of anticipatory bail. The 2nd respondent/de-facto complainant lodged a complaint stating that she was acquainted with this petitioner since 2019 and had physical relation. However, this petitioner refused the marriage proposal, since the de-facto complainant belongs to SC community.

Aggrieved by the said refusal, the complaint was filed which was registered by the Police on 05.08.2023.

However, the 1st petitioner and the 2nd respondent got married on 11.08.2023 and the said marriage was registered with the Office of Registrar of Marriages. Both, the 1st petitioner and the de-facto complainant are present in the Court. On enquiry by the learned Additional Public Prosecutor, the 2nd respondent/ de-facto complainant stated that she was married and she has no grievance against the petitioner. Accordingly, the relief of anticipatory bail can be granted to the petitioner, subject to the following conditions:

1) The petitioners/Accused Nos.1 and 2 are directed to surrender before the Station House Officer, Manuguru Police Station, Bhadradri Kothgudem District, on 19.09.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) for a like sum each to his satisfaction.

2) On such release, petitioners/Accused Nos.1 and 2 shall appear before the concerned Station House Officer for the purpose of investigation, as and when required.

3) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
