THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.21539 of 2015 ORDER :

Heard learned counsel for petitioner and Sri Chatla Madhu, learned standing counsel for respondent GHMC and with their consent, the writ petition is taken up for disposal at the admission stage.

2. This writ petition is filed questioning the action of the respondents 1 to 4 in not taking action on the representations of the petitioner dated 10.06.2015 and 22.06.2015 regarding unauthorized constructions made by 5th respondent in Plot No.176, Sy.No.869/1, Mallikarjuna Nagar, Malkajgiri, Ranga Reddy District, as illegal and for a consequential direction to take action against the 5th respondent.

3. Petitioner claims that she is the owner and possessor of Plot No.177, H.No.18-498/2, Mallikarjuna Nagar, Malkajgiri, Hyderabad. The grievance of the petitioner is that 5th respondent is constructing building with five floors, and on coming to know that such constructions are made unauthorisedly without having any sanctioned permission, petitioner has submitted representations dated 10.06.2015 and 22.06.2015 to respondent corporation requesting to take action against the unauthorized constructions, however no action is taken thereon and the same is pending. Since no action is being taken by the officials of respondent corporation, the present writ petition is filed.

4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the respondents 2 to 4 to expeditiously dispose of the representations of the petitioner dated 10.6.2015 and 22.06.2015.

5. Having regard to the same, without expressing any

opinion on the merits of the matter, writ petition is disposed of directing respondents 2 to 4 to consider the representations of the petitioner dated 10.6.2015 and 22.06.2015 and pass appropriate orders as warranted under law within a period of six weeks from the date of receipt of copy of this order and communicate the decision to the petitioner. It is needless to mention that prior notice and opportunity of hearing be afforded to 5th respondent. No costs.
