THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38682 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the third respondent in interfering with the personal life and liberty of the petitioners by pressurizing the petitioners to handover the house sites assigned in favour of the petitioners in an extent of Acs.0.01/4 cents (plot No.28) in survey No.473 and Acs.0.01/2 cents in survey No.216 of Raptadu Village and Mandal, Ananthapuram District to the respondents 4 to 8 as arbitrary and illegal, and consequently to direct the third respondent not to interfere with the personal life and liberty of the petitioners and also not to pressurize the petitioners to handover the house sites in the said lands to the respondents 4 to 8.

Heard and perused the material.

Learned counsel for the petitioners submits that the third respondent is interfering with the personal affairs of the petitioners and is pressurizing the petitioners to handover their house sites to the respondents 4 to 8. He further submits that the respondents 4 to 8, in order to grab the property of the petitioners, are influencing the third respondent and as such, seeks a direction to the third respondent not to interfere with the personal affairs of the petitioners and also not to pressurize the petitioners to handover their house sites to the respondents 4 to 8.

Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the third respondent is not interfering with the affairs of the petitioners, and more particularly the civil disputes between the petitioners and the respondents 4 to 8.

Considering the rival submissions of the learned counsel for the petitioners and the Assistant Government Pleader for Home (Andhra Pradesh), and also considering the facts and circumstances of the case, the third respondent is directed not to interfere with the affairs of the petitioners and also not to pressurize the petitioners to handover their house sites to the respondents 4 to 8. The third respondent is directed to follow due process of law laid down in Code of Criminal Procedure. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 10.11.2016 pln
