THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34228 OF 2014 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondent authorities in not taking action against the fifth respondent in accordance with the complaint filed by the petitioner on 02.09.2013 and 08.07.2014 as illegal and arbitrary, and consequently direct the respondent authorities to conduct a thorough investigation in respect of the complaint filed by the petitioner against the fifth respondent. Heard and perused the material.

It is evident from the record that without therebeing any complaint to any authority concerned, the petitioner approaches this Court with a prayer to direct investigation by the Central Bureau of Investigation (CBI) against the fifth respondent herein, basing on the representation of the petitioner. The petitioner has not initiated any criminal action either by way of complaint to the competent authority or before the Court concerned, which is empowered to take cognizance of any of the offences committed by the fifth respondent.

This Court is of the view that the writ petition can be disposed of with a liberty to the petitioner to approach this Court after filing any complaint before the competent authority, if he so desires and if there is any refusal to take cognizance of the offences by any competent Court.
