HON'BLE SRI JUSTICE S.V. BHATT W.P.No.44308 OF 2016 ORDER:

Heard Mr.Bollam Lingaiah Yadav for petitioner and Mr.Ch.Venkat Yadav, Government Pleader for respondents. The petitioner prays for the following relief: "......this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent herein in not releasing the seized stocks of rice 150 bags equivalent 75.00 quintals and 200 bags equivalent to 100 quintals total 350 bags each 50 Kg.

Bag in favour of the petitioner as per Representation dated 14-12-2016 of the petitioner even pending 6-A proceedings to remit the same in the CMR Rice Account of the 3rd respondent herein, which was seized as per Panchanama dated 09-12-2016 conducted by 4th respondent as illegal, arbitrary and in violation of Principles of Natural Justice, consequently direct the 2nd respondent to release the entire seized stocks of rice 150 bags equivalent 75.00 quintals and 200 bags equivalent to 100 quintals total 350 bags each 50 Kg. Bag in favour of the petitioner even pending 6-A proceedings to remit the same in the CMR Rice Account of the 3rd respondent herein, and to pass ....." The petitioner submits that on 04.12.2016 a petition for orders including release of stock etc.

, was made before the 2nd respondent and the 2nd respondent may be directed to consider and dispose of the petition within reasonable time. The learned Government Pleader submits that the 2nd respondent would pass orders as are warranted in the fact situation of the case within four weeks from the date of receipt of a copy of this order.

Having regard to the limited submissions noted above, the writ petition is disposed of by this order:

The 2nd respondent is directed to dispose of the petition filed by the petitioner on 14.12.2016 for release of stock within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, also stand disposed of.
