ORDER:

This writ petition is filed for a mandamus to declare the encroachment made by the respondents upon the petitioner's property bearing plot No.19, in survey Nos.105 and 106, Municipal House bearing No.27-16/9/1/2/1 (old No.22-16/19) admeasuring 216 sq.yds. situated at Srikrishna Nagar, Malkajgiri, Hyderabad, without following due process of law, and the erection of fencing over the aforesaid property, as illegal and arbitrary.

After arguing the case, Mr.M.W.R.Jayakar, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition, with liberty to his client to file a fresh writ petition, with proper description of the respondents and proper Annexure - I. The Writ Petition is, accordingly, dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made. As a sequel to dismissal of the writ petition, W.P.M.P.No.3491 of 2016 filed by the petitioner for interim relief shall stand dismissed as infructuous.
