HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1549 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the action of the 2nd respondent in not disposing the appeal and stay application dated 28.09.2016 as illegal and arbitrary and consequently to set aside the report of the 3rd respondent vide proceeding No.A5/271/2014, dated 04.02.2015. The grievance of the petitioner is that though the petitioner filed appeal before the 2nd respondent on 28.09.2016 against the proceedings of the 3rd respondent dated 04.02.2015, the 2nd respondent has not passed any orders on the appeal and stay petition filed by the petitioner. Meanwhile, the respondents are trying to give effect to the proceedings of the 3rd respondent dated 04.02.2015. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Revenue and learned counsel for the 7th respondent-Temple.

Since the appeal filed by the petitioner is pending before the 2nd respondent, the 2nd respondent is directed to dispose of the said appeal in accordance with law. Till disposal of the appeal by the 2nd respondent, there shall be stay of impugned proceedings of the 3rd respondent dated 04.02.2015.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of the writ petition, miscellaneous petitions, if any, pending shall stand closed.
