THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.2771 OF 2017 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to grant prearrest bail to the petitioner/A.2 apprehending his arrest in connection with Crime No.23 of 2017 of Tanakal Police Station, Anantapur District, registered for the offences punishable under Sections 420 and 506 of the Indian Penal Code, 1860 (for short 'I.P.C.').

2) The de facto complainant-Ramu Naik Mude filed a private complaint against the petitioner and 2 others alleging that accused Nos.1 and 3 informed that there are vacancies of the post of Staff Nurses, the Director of the SVIMS Hospital, is well known to them and they will provide employment to the daughter of de facto complainant and collected huge amount of Rs.6,10,000/-. It is also alleged that this petitioner is also one of the person who induced the de facto complainant, with dishonest intention to part with huge amount and telephoned to the complainant with 23 different phone numbers.

3) Learned counsel for the petitioner contended that the petitioner is also victim in the hands of A.1 and A.3 and no amount was credited to the account of petitioner, thereby he sought prearrest bail. 4) As seen from the allegations made in the complaint, the petitioner along with two others allegedly made false representation to provide employment and induced various persons with dishonest

MSM,J Crl.P_2771_2017 intention to part with huge amount on the pretext of providing employment, as such the act of accused persons, who are collecting such huge amounts, certainly attract the offence punishable under Section 420 IPC. Therefore, I find it is not a fit case to enlarge the petitioner on pre-arrest bail.

5) In the result, the Criminal Petition is dismissed. 6) Consequently, miscellaneous petitions, if any, pending in this Petition shall stand closed.
