There is no representation for the petitioner. 2.

The prayer sought in this Writ Petition is as under: "........to issue Writ of Mandamus declaring the inaction of the 3rd respondent in failing to take action against the respondent No.4 and his henchmen as illegal, arbitrary and contrary to law."

From the perusal of the contents of the affidavit filed in support of the Writ Petition, it is clear that the petitioner has a grievance against the 4th respondent relating to a residential house. The contents clearly make out a civil dispute between the petitioner and the 4th respondent.

Though in the affidavit, it is mentioned that in spite of bringing to the notice of the 2nd and 3rd respondents, they have not taken any action, the entire affidavit is silent as to on what date the complaint was lodged with the 3rd respondent. Though the allegations mentioned in the affidavit are serious in nature but the petitioner has not filed any evidence to prove that it was brought to the notice of the 2nd and 3rd respondents. In the absence of any evidence, that complaint was lodged with the 3rd respondent, this Court cannot grant any relief to the petitioner.

Therefore, there are no merits in the Writ Petition and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. No costs. 7.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
