HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.4297, 4298 and 4299 OF 2013 COMMON ORDER:
These writ petitions are filed to declare the proceedings issued by the 1st respondent in Rc.No.NN1/34576/07, dated 24-12-2008 directing the 6th respondent not to register the properties in the annexed list including the petitioners lands respectively claiming those properties are Endowments Lands, contrary to the judgment of Supreme Court in P.V.M.D.Iyengar v. Government of A.P. (1996 SCC (3) 75) and contrary to the provisions of the A.P.Chandritable and Hindu Religious Institutions and Endowments Act, 1987 as illegal.
In all these writ petitions, this Court granted interim order on 13-02-2013 subject to the result of Second Appeal No.1092 of 2010. Now final judgment, dated 21-04-2014 in S.A.Nos.1091 and 1092 of 2010 produced before this Court. Learned counsel for the petitioners as well as Smt.K.Lalitha, learned Standing Counsel for the 4th respondent-temple states that since Second Appeal No.1092 of 2010 filed by temple is dismissed, these writ petitions can be disposed of. It is also stated by learned Standing Counsel that they are accepting the orders in the Second Appeal. In view of orders in the Second Appeal, the impugned order dated 24-12-2008 is liable to be set aside.
Accordingly, these writ petitions are allowed. The impugned order dated 2412-2008 is set aside. As a sequel to the disposal of these petitions, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-07-2016 nvl
