THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21348 of 2018 ORDER:

Heard Smt. Y.Mahalakshmi for petitioner and the learned Assistant Government Pleader for Revenue. The subject matter of the writ petition is an extent of Ac.1-87 cents in Sy.No.761/10 and Ac.0-66 cents in Sy.No.761/11 of Nagamvandlapalli Village, Irala Mandal, Chittoor District.

The petitioner complains that respondent Nos.4 to 6 are dispossessing the petitioner from the subject matter of the writ petition. The petitioner has impleaded respondent Nos.7 to 11. As a few of the averments referred to alleged interference by official respondents at the instance of respondent Nos.7 to 11, the petitioner has placed on record annexure-P7, the affidavit in I.A.No.504 of 2017 in O.S.No.459 of 2017. The respondent Nos.7 to 11 are defendants in the suit filed by the petitioner. Prima facie, it appears that the writ prayer is misconceived. Against the alleged interference, the petitioner has already invoked the remedy by filing O.S.No.459 of 2017 vis-à-vis respondent Nos.7 to 11. It is also a matter of record in I.A.No.504 of 2017 ad interim injunction has been granted

in favour of the petitioner. Now, reverting back to allegations against respondent Nos.4 to 6, it appears that appeal is pending before the District Collector in Case No.E4/28/2017 dated 08.05.2018.

The Assistant Government Pleader places on record the written instructions dated 22.06.2018 and informs the Court that the Joint Collector has heard the matter and orders are awaited.

This Court is not examining the issue pending before the District Collector/Joint Collector, Chittoor. However, to meet the ends of justice, the writ petition is disposed of by directing the 2nd respondent to pass orders, as expeditiously as possible, preferably within four (04) weeks from today. The parties, if aggrieved by the order of 2nd respondent, can work out the remedies in accordance with law. With the above observations, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
