THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.25694 of 2016 ORDER:

Heard Sri J.Venkateshwar Reddy for petitioner, Sri S.Siva Kumari for the 1st respondent, Sri S.S.Varma for the 2nd respondent, the Assistant Government Pleader for Land Acquisition for the 3rd respondent and Sri C.Damodar Reddy for respondents 4 and 5. The prayer is one against inaction of respondent No.3 in considering the request of the petitioner for reference under Section 3H(4) of the National Highways Act, 1956 as arbitrary and amounts to refusing to exercise the jurisdiction conferred on the 3rd respondent.

With the assistance of learned counsel appearing for parties, I have perused the representation dated 14-10-2015. It is not in dispute that the 3rd respondent did not issue notices to any of the parties pursuant to representation, dated 14-10-2015 or has taken a decision.

Since the prayer is one against inaction, it shall not be understood as this Court expressing any view on the merits of the case of petitioner vis-à-vis respondent Nos.4 and 5. However, the 3rd respondent is directed to consider and pass appropriate orders in accordance with law on the petitioner's representation dated

14-10-2015 within eight weeks from the date of receipt of a copy of this order.

The writ petition is accordingly disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
