THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4442 of 2007 ORDER:

This Writ Petition is filed challenging the inclusion of the name of the third respondent in the selected candidates' list by deleting the name of the petitioner, for the post of Anganwadi Worker of Kothur Village, Kalyandurg Mandal, Anantapur District.

On 02.03.2007, this Court while admitting the Writ Petition, in WPMP.No.5659 of 2007 filed for issuance of a direction to respondents 1 and 2 not to appoint the third respondent or any other person for the post of Anganwadi Worker at Kothur Village, permitted the petitioner to take out personal notice to the third respondent and file proof of service. On 30.04.2009, this Court observed that the petitioner failed to carry out the said order and the third respondent remained unserved and thereby, dismissed the said WPMP. Today, when the case is taken up for consideration, learned counsel for the petitioner submits that even though the aforesaid WPMP was dismissed, respondents 1 and 2 did not appoint

ARLR, J W.P.No.4442 of 2007 anyone as Anganwadi Worker of Kothur Village, Kalyandurg Mandal, Anantapur District.

In view of non-service of notice on the third respondent, this Writ Petition is dismissed giving liberty to respondents 1 and 2 to appoint Anganwadi Worker in respect of Kothur Village, Kalyandurg Mandal, Anantapur District, in accordance with law.
