Satha Shanker v. The Chairman And Managing Director,
THE HON'BLE SRI JUSTI CE C.PRAVEEN KUMAR W RI T PETI TI ON No. 2 7 5 5 3 of 2 0 1 7 ORDER:
Heard.
2.
The present Writ Petition came to be filed with the following prayer:
'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of respondents in not referring the petitioner's case to the Corporate Medical Board of the respondents-company, as illegal and arbitrary'. 3.
Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to consider the representation dated 20.07.2017, made by the petitioner to the first respondent for his medical examination through Corporate Medical Board. Learned Standing Counsel for Singareni Collieries Company Limited, appearing on behalf of respondents, does not dispute the same. 4.
Having regard to the above, without going into merits of the case, the writ petition is disposed of directing the first respondent to consider the representation dated 20.07.2017, made by the petitioner, in accordance with law, as early as possible, preferably within a period of six weeks from the date of receipt of a copy of the order.
5.
Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ JUSTI CE C.PRAVEEN KUMAR 18.08.2017, vhb
