THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3291 of 2009 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondents 1 to 6 in not implementing their own G.O.Ms.No.352, M.A, dated 30.07.2001 and also HADA Notification No.248/HADA/01/2001 and thereby respondent No.7 violating the aforesaid G.O., as arbitrary and illegal.

Though the Writ Petition was admitted on 26.07.2010, no interim order was granted and further, the writ petition was dismissed against 7th respondent for non-payment of batta on 25.04.2013. Since the relief claimed in the writ petition is against the 7th respondent, it cannot be heard without making the 7th respondent as party.

Hence, the Writ Petition is dismissed. However, if there are any violations, the Writ Petitioner is at liberty to take necessary steps in accordance with law.
