THE HON'BLE THE CHIEF JUSTICE UJJAL BHUYAN AND THE HON'BLE SRI JUSTICE N. TUKARAMJI WRIT PETITION No.31437 of 2022 ORDER: (Per the Hon'ble the Chief Justice Ujjal Bhuyan) Heard Mr. K.Muralidhar Reddy, learned counsel for the petitioner and Ms. P.Bhavana Rao, learned Government Pleader for Land Acquisition representing respondent Nos.1 to 5.

Though respondents have filed counter affidavit raising various contentions, we are of the view that it is not necessary to enter into the same having regard to the relief sought for by the petitioner.

Petitioner claims to be a project affected person; rather a displaced person of the Aelimineti Madhava Reddy Project (Akkampally Balancing Reservoir). According to him, for the aforesaid project and as part of the award, State Government had announced Rehabilitation and

HCJ & NTRJ W.P.No.31437 of 2022 Resettlement Package vide G.O.Ms.No.68 dated 08.04.2005. In terms thereof, petitioner was allotted residential Plot No.1390 in Pedda Adisherla Pally Village and also a layout in Plot No.1390 in the commercial complex of the said Village. Grievance of the petitioner is that in the residential plot, one Narasamma was trying to make construction. He submitted a representation dated 16.07.2022 before the 7th respondent i.e., Tahsildar of Pedda Adisherla Pally Village and Mandal, Nalgonda District requesting the said authority to stop illegal construction.

Without expressing any opinion on merit, we direct 7th respondent to take on board the above representation of the petitioner and after giving due opportunity of hearing to the petitioner and other concerned person(s), he shall take appropriate steps in accordance with law.

Let the above exercise be carried within a period of two (02) months from the date of receipt of a copy of this order.

Writ Petition is accordingly disposed of.

However, there shall be no order as to costs. 7.

Miscellaneous applications pending, if any, in this Writ Petition shall stand closed.
