THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.8308 OF 2021 ORDER:

This is an application for regular bail. The petitioner is accused No.2 in Crime No.316 of 2021 of P.S. Bhadrachalam Town, Kothagudem District. The offence alleged against the petitioner is under Section 8(c) r/w 20 (b) of NDPS Act, 1985. 2.

Heard Sri K.Durga Prasad, learned counsel for the petitioner and the learned Public Prosecutor. Perused the record.

The allegation against the petitioner herein/A2 is that he along with other accused transported 300 kgs of Ganja. The petitioner/A2 is also in the vehicle in which the said Ganja was seized at the time of committing of offence. Perusal of the record would reveal that the petitioner herein/A2 was arrested on 30.07.2021. Learned Public Prosecutor, on instructions, would submit that the Investigating Officer has already completed investigation and laid charge sheet. According to learned Public Prosecutor, the Investigating Officer has already arrested A1 and he is in jail. Prima facie, there are allegations against A1. The petitioner herein has not involved in any other case except the present crime. The petitioner herein/A2 is also an agriculturist. 4.

Considering the said aspects, this Court is inclined to grant regular bail to the petitioner herein/A2.

Accordingly, the Criminal Petition is allowed and the petitioner/A2 is granted bail subject to the following conditions:

i. The petitioner/A2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for the like sum each to the satisfaction of the Special Designated Judge for trial of cases under Narcotic Drugs and Psychotropic Substances Act, 1985-cum- I Additional Sessions Judge, Khammam.

ii. The petitioner/A2 shall cooperate with the trial Court in concluding trial.

Miscellaneous petitions pending, if any, shall stand disposed of.
