THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE Dr. JUSTI CE SHAMEEM AKTHER WRI T PETI TI ON No.11653 of 2005 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed by some of the respondents in L.G.C. No.125 of 1998 on the file of the Special Court under the A.P. Land Grabbing (Prohibition) Act, 1982, aggrieved by the judgment dated 29.03.2005 passed therein declaring them to be land grabbers and directing them to vacate and hand over possession of the petition schedule property to the applicant therein, the State of Andhra Pradesh. By order dated 24.05.2005, this Court granted interim suspension of the judgment under challenge but directed the petitioners not to alienate or create any encumbrance or otherwise alter the nature of the property.
It is now brought to our notice by Sri Vedula Srinivas, learned counsel for the petitioners, that the very same judgment dated 29.03.2005 in L.G.C. No.125 of 1998 fell for consideration before this Court in W.P. Nos.12608 and 8904 of 2005 and by common order dated 23.03.2011, a Division Bench of this Court allowed the said writ petitions and set aside the judgment passed in the said L.G.C. by the Special Court. In that view of the matter, this writ petition does not merit independent consideration as it is squarely covered by the aforesaid common order.
For reasons alike as were mentioned in the aforesaid common order dated 23.03.2011 passed in W.P.Nos.12608 and 8904 of 2005 and
SK,J & Dr.SA,J wp_11653_2005 in terms thereof, this writ petition is allowed setting aside the judgment 29.03.2005 passed by the Special Court in L.G.C. No.125 of 1998. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
