Subhash Reddy) This appeal, under Section 28 of the Hindu Marriage Act, 1955, is preferred against the order dated 25.07.2003 in O.P.No.110 of 2002 on the file of the Judge, Family Court at Secunderabad, by which the petition filed by the appellant - husband, under Section 9 of the Hindu Marriage Act, for restitution of conjugal rights and other reliefs, was rejected.

Though the appeal is of the year 2003, when the matter has come up for hearing, there is no representation for the appellant and it indicates that the appellant is not interested in pursuing the appeal.

Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
